LIMITED WARRANTY STATEMENT

Twelve (12) months Parts and Labour Warranty return to depot on controls and accessories purchased from KJ ELECTRICAL CONTRACTING LTD. ("Seller"), from the date of original purchase. The Seller hereby clearly states that all products subject to this warranty, unless otherwise indicated on the invoice to the customer, are used and/or refurbished products.

This warranty covers failure of controls or accessories HARDWARE ONLY under normal use. Damage caused by misuse, abuse, improper installation, products that have been tampered with, opened by unauthorized persons, or not used with the instructions or ratings supplied, if applicable, with the product, are NOT covered by this warranty.

This warranty is limited to the value of the product supplied, as indicated on the original purchase invoice, and in no cases includes coverage for consequential damages, loss of earnings or profits, or any other damages incurred by the use, misuse, or failure of these products. This disclaimer is expanded below.

SUBJECT TO THE REPRESENTATIONS MADE IN THE WARRANTY STATEMENT SELLER MAKES NO OTHER REPRESENTATION OR WARRANTY OF ANY KIND. EXPRESS OR IMPLIED, AS TO MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE WITH RESPECT TO THE PRODUCT(S) COVERED UNDER THIS WARRANTY. THE TOTAL LIABILITY OF THE SELLER FOR ANY AND ALL LOSSES OR DAMAGES ARISING OUT OF ANY CAUSE WHATSOEVER, WHETHER SUCH CAUSE BE BASED IN CONTRACT, NEGLIGENCE, STRICT LIABILITY, OTHER TORT OR OTHERWISE, SHALL IN NO EVENT EXCEED THE PURCHASE PRICE OF THE PRODUCT OR, AT SELLER'S OPTION, REPLACEMENT OF SUCH PRODUCT. IN NO EVENT SHALL SELLER BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES RESULTING FROM ANY SUCH CAUSES. SELLER is not responsible for system downtime, test data or programs, or software compatibility or incompatibility. SELLER does not warrant that the use of the goods will be uninterrupted or the results of use will be error free, in terms of compatibility, correctness, accuracy or reliability. In no event shall SELLER be liable for any loss of use, revenue, or profit of the Customer, or for any direct, indirect or consequential damages arising out of, connected with, or resulting from the sale or non-performance of goods.
